BSB 2023: Chapter IX: Section 124

All persons shall be competent to testify unless the Court considers that they are prevented from understanding the questions put to them, or from giving rational answers to those questions, by tender years, extreme old age, disease, whether of body or mind, or any other cause of the same kind.
Explanation.—A person with mental illness is not incompetent to testify, unless he is prevented by his mental illness from understanding the questions put to him and giving rational answers to them.

सभी व्यक्ति गवाही देने के लिए सक्षम होंगे जब तक कि न्यायालय यह नहीं मानता कि उन्हें उनसे पूछे गए प्रश्नों को समझने से, या उन प्रश्नों के तर्कसंगत उत्तर देने से, कम उम्र, अत्यधिक बुढ़ापे, बीमारी, चाहे वे शरीर के हों या मन, या इसी तरह का कोई अन्य कारण।
स्पष्टीकरण.—मानसिक बीमारी से ग्रस्त व्यक्ति गवाही देने में अक्षम नहीं है, जब तक कि उसे उसकी मानसिक बीमारी के कारण उससे पूछे गए प्रश्नों को समझने और उनके तर्कसंगत उत्तर देने से रोका न जाए।
